These terms and conditions outline the rules and regulations for the use of Moon Art and Masters' Website, located at www.moonartandmasters.com (the “Site”). We encourage you to read these terms and conditions completely and check our Site frequently to see any changes that may have been made to them. By accessing the Site we assume you accept these terms and conditions. If you do not agree to these terms and conditions, you may not access or use the Site.
INTELLECTUAL PROPERTY
The Site and all of its original content are the sole property of Moon Art and Masters and are, as such, fully protected by the appropriate international copyright and other intellectual property rights laws. No materials from the Site may be copied, reproduced, republished, uploaded, or distributed in any way, unless properly licensed to do so by us. You may not download or save a copy of any of the content of screens for any purpose except as otherwise provided by us.
ARTWORKS
We have made every effort to display as accurately as possible the colors and images of our artworks that appear on the website. We cannot guarantee that your computer monitor's display of any color will be accurate.
RISK OF LOSS
The risk of loss or damage to the artworks purchased from our website shall pass to the client upon delivery of the artworks. All Moon Art and Masters’ packages must be accepted and signed for upon delivery. Due to the valuable nature of artworks, delivered artworks should not be left unattended.
SHIPPING
Most orders are shipped within 14 business days. However, some artworks might take more time. If you order more than one artwork, they may be shipped separately. Please go to My Account and find your current order status in ‘order history’ or contact us for the expected processing time.
PERSONAL INFORMATION
Personal information that you voluntarily give us through the Site or other direct contact from you is governed by our Privacy Policy.
TERMINATION
The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
These Terms and Conditions are effective unless and until terminated by either you or us. You may terminate these Terms and Conditions at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms and Conditions, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).
WARRANTY
Moon Art and Masters warrants that it has the right to provide artworks and/or services (the “Goods”) but otherwise the Goods are provided on an “as-is” basis without warranty of any kind, express or implied, oral or written including, without limitation, the implied conditions of merchantable quality, fitness for purpose and description, all of which are specifically and unreservedly excluded. In particular, but without limitation, no warranty is given that the Goods are suitable for the purposes intended by the user.
Moon Art and Maters warrants that the Goods will be supplied using reasonable care and skill. The Company does not warrant that the Goods supplied are error-free, accurate or complete.
ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION
Occasionally there may be information on our Site that contains typographical errors, inaccuracies or omissions that may relate to artwork descriptions, pricing, promotions, offers, artwork shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information on the Site is inaccurate at any time without prior notice (including after you have submitted your order).
Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on the Site for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.
Your use of any information or materials on this Site is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any products, services or information available through this Site meet your specific requirements.
DISCLAIMER
All artworks purchased from us must be handled, installed and stored properly by the owner. Once the delivery has been signed for the artwork is no longer insured by us. However, we will do our best for restoration where possible when requested by the owner. If this is the case, the owner of the artwork is solely responsible for the costs of restoration and other expenses incurred.
All artworks that Moon Art and Masters provide are accompanied by a Certificate of Authenticity. However, it may not be issued again, so please keep it in a safe place.
CHANGES
Moon Art and Masters reserves the right to change these terms and conditions from time to time without notice.
